Terms of Use.

These Terms of Use (“Terms”) govern your access to and use of the daily application, website, and related services (collectively, the “Service”), developed and operated by Felix Haimerl (“we”, “us”, or “our”).

By downloading, accessing, or using daily, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Scope and Purpose of the Service

daily is a digital productivity tool designed to help users manage tasks, projects, habits, and related personal information.

The Service is provided for personal, non-commercial use unless explicitly agreed otherwise in writing.

2. Eligibility

You must be at least 16 years old (or the minimum age required by applicable law in your jurisdiction) to use the Service.

By using daily, you represent that you have the legal capacity to enter into a binding agreement.

3. Account & App Store Access

daily may be downloaded through third-party app stores. Any account creation, billing, or authentication handled by such app stores is governed by their respective terms and policies.

We do not control or operate third-party app store services.

4. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use daily on compatible devices solely for your personal use in accordance with these Terms.

No ownership rights are transferred to you.

5. User Content & Data

You retain full ownership of any content you create, input, or store in daily (“User Content”). You are solely responsible for your User Content.

Data is stored locally on your device. If iCloud synchronization is enabled, data is stored in your personal iCloud account. We do not access or analyze your User Content.

All intellectual property rights related to the Service remain the exclusive property of Felix Haimerl or licensed rights holders.

8. Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time, including these Terms.

9. Subscriptions & Paid Features

daily is currently free. Optional paid features or subscriptions may be offered in the future. Any such offerings will be clearly disclosed prior to purchase.

10. No Warranty

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect or consequential damages. Our total liability shall not exceed EUR 50 unless mandatory law provides otherwise.

12. Termination

You may stop using the Service at any time by uninstalling the app. We may terminate or suspend access if required by law or in case of misuse.

13. Privacy & Data Protection

Personal data is processed in accordance with our Privacy Policy.

14. Third-Party Services

We are not responsible for third-party services or their availability.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection laws remain unaffected.

16. Severability

If any provision of these Terms is held invalid, the remaining provisions remain in effect.
